The Strasbourg City Council unanimously adopted, during its session on September 23, 2023, the establishment of a right of pre-emption applicable to the transfers for valuable consideration of business assets, artisanal assets, and commercial leases within the perimeter of the city of Strasbourg (Resolution No. 51).
Objectives
This measure was adopter in order to:
👉 maintain a diverse range of offerings in the city center and neighborhoods to meet the needs of the resident clientele,
👉 preserve the typology of existing activities, particularly independent merchants and artisans,
👉 ensure the enhancement of city entrances and anticipate commercial changes.
Scope of the pre-emption right
Area
The scope of the pre-emption right is as follows:
👉 the entire Grande Île district,
👉 the train station area – from the boulevards of Metz, Nancy, and Lyon to Molsheim street, street Sainte Marguerite to Place des Halles, including Place de la Gare and Maire Kuss street,
👉 the northern sector of the city center, from Place des Halles to Fossé des Treize street,
👉 the Krutenau district, from Première Armée street (up to Place de la Bourse) to Sainte Madeleine street, quai des Bateliers, and quai des Pêcheurs,
👉 the Cronenbourg district, between Oberhausbergen street, passing by Rotonde, Mittelhausbergen street, to the railway line,
👉 the commercial sector along Polygone street in Neudorf, – the commercial heart of the Meinau district around Place de l’Île de France,
👉 in the Montagne Verte district, along Schirmeck street and part of rue d’Ostwald,
👉 the Elsau sector around Watteau, Léonard De Vinci, and Mathias Grünewald streets,
👉 in the Koenigshoffen district, along part Romains street and Comtes passage,
👉 the commercial sector of Neuhof on a portion of d’Altenheim street and Parallèle street.
Transfers targeted by the pre-emption right
In accordance with article L. 214-1 of the French Code de l’urbanisme, the pre-emption right shall apply to all transfers for valuable consideration of of business assets, artisanal assets, commercial leases, or land hosting or intended to host businesses with a sales area between 300 and 1,000 square meters..
Increased vigilance
Therefore, caution is advised, as these transfers will now be subject to the formalism of prior declaration, under penalty of nullity!
